By creating an account, joining our waitlist, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service. We reserve the right to modify these Terms at any time, with notice provided via email or on the Service.

2. Description of Service

ScalePod AI is an AI-powered platform that automates the print-on-demand product lifecycle, including design generation, mockup creation, SEO copywriting, pricing optimization, and publishing to marketplace platforms such as Etsy via fulfillment providers such as Printify.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Generate content that infringes on the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated scripts to access the Service outside of provided APIs
• Resell or redistribute the Service without written authorization
• Upload malicious code or interfere with the Service's infrastructure

5. Intellectual Property

Your Content: You retain ownership of all content you create using the Service, including design briefs, product descriptions, and generated images. You grant us a limited license to process and store this content to provide the Service.

AI-Generated Content: Images and text generated by the Service's AI systems are provided for your commercial use. You are responsible for ensuring that generated content does not infringe on third-party rights before publishing.

Our Platform: The Service, including its design, code, algorithms, and documentation, is owned by ScalePod AI and protected by intellectual property laws.

6. Third-Party Integrations

The Service integrates with third-party platforms including Printify, Etsy, and AI services. Your use of these integrations is subject to the respective third-party terms. We are not responsible for the availability, accuracy, or actions of third-party services.

7. Data Processing and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We may use advertising and analytics technologies (including Google Ads, Meta Pixel, and Pinterest Tag) to promote the Service and measure effectiveness. You may opt out of personalized advertising as described in our Privacy Policy.

8. Payment and Billing

Pricing for the Service will be announced prior to launch. Founding members who join the waitlist may receive preferential pricing. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice to existing subscribers.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will provide reasonable notice for planned maintenance.

10. Limitation of Liability

To the maximum extent permitted by law, ScalePod AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI-generated content will be free of errors, commercially successful, or suitable for your specific use case. You are responsible for reviewing and approving all content before publishing.

12. Indemnification

You agree to indemnify and hold harmless ScalePod AI and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases. You may request export of your data within 30 days of termination.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which ScalePod AI is incorporated, without regard to conflict of law provisions. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.
